Service Delivery Policy

Our services fall into two categories:

1. Software platform

Our Carbon Neutral reporting tool operates as an online software platform. Customers are entitled to access the platform interactively for a 3-month period from the date of each yearly payment. The yearly reporting service is deemed to be fulfilled at the end of the 3-month period. Our platform will continue to store and make available client data beyond the 3-month period as a free service, but this extended period does not include any support or service level guarantees. Where clients choose to enable the public version of the report, this will continue to be available through our Carbon Neutral Badge server for a period of at least 12 months beyond the date of publication as a free service to all clients.

2. Advanced consulting services which are negotiated on a case-by-case basis

Delivery of these services will depend on each case, payment will only be due once the work is completed

Service Usage Terms

Each subscription or service procured from Counting Carbon is bound to a single organisation and a single reporting period, this means you need to pay for separate services for each organisation and for each reporting period. The service will need to be explicitly renewed by the client as required.

The service provided by Counting Carbon is highly dependent on the data provided by the client, we cannot be held responsible for the content of the reports we create if the data or information provided to us is not correct. However, if our system creates a report containing incorrect values due to a calculation error or incorrect formula selection, we will review, correct and re-issue the report free of any additional fees.

Our service comes with a 99% uptime target and can be expected to be available 24 hours per day. Where possible, we will attempt to notify in advance of any scheduled maintenance work likely to disrupt the service, but we cannot guarantee it.

Refund Policy

All of our online services come with a 30-day refund policy. If our online service fails to meet your needs for any reason, you may request a full refund within 30 days of purchase. This refund policy does not include our consulting or specifically quoted services once these services are delivered.

Counting Carbon will abide by Australian Consumer Law in regards to refunds where we fail to deliver the service you have purchased.

Liability and indemnity

You indemnify us against all losses, costs (including legal costs), expenses, demands or liability that we incur arising out of, or in connection with, a third-party claim against us relating to your use of our services or any third-party product (except as to the extent we are at fault for).

Our services and all third-party products are made available to you on an "as is" basis. Subject to the applicable consumer law, we disclaim all warranties, express or implied, including any implied warranties of non-infringement, merchantability and fitness for a particular purpose.

Other than liability that we can't exclude or limit by law, our liability to you in connection with our services or these terms, in contract, tort (including negligence) or otherwise, is limited as follows:

  • We have no liability arising from your use of our services for any loss of revenue or profit, loss of goodwill, loss of customers, loss of capital, loss of anticipated savings, legal, tax or accounting compliance issues, damage to reputation, loss in connection with any other contract, or indirect, consequential, incidental, punitive, exemplary or special loss, damage or expense.
  • For loss or corruption of your data, our liability will be limited to taking reasonable steps to try and recover that data from our available backups.
  • Our total aggregate liability to you in any circumstances is limited to the total amount you paid us in the 12 months immediately preceding the date on which the claim giving rise to the liability arose.
